About this workshop

This workshop examines the key practical issues associated with cheques, distinguishing between cheques used as a means of payment and those used as security. It explores the liability of authorized signatories and the impact of a debtor company’s liquidation or bankruptcy on the obligations arising from cheques. The workshop also addresses the most appropriate legal course of action in each case, whether enforcement proceedings, an order for payment, or a judicial claim, in light of Federal Decree-Law No. (50) of 2022 Promulgating the Commercial Transactions Law of the United Arab Emirates.

What you will learn

  • In our latest workshop, held in collaboration with HAMG Academy, we explored the topic “Cheques as a Means of Payment and Security” through five key questions:
  • When is a cheque considered a means of payment?
  • Who bears the burden of proving that a cheque was issued as security?
  • What is the liability of an authorized signatory who assumes the obligation of a personal guarantor?
  • How does a company’s liquidation or bankruptcy affect the guarantor’s obligations?
  • What are the legal consequences of each scenario?
  • In this presentation, we address these five key points in light of Federal Decree-Law No. (50) of 2022 Promulgating the Commercial Transactions Law in the United Arab Emirates.
